Course description

Here the basic objective is the practice of the legal aspects of the administration of a condominium and therefore, from the point of view of professional figures, the legal competence of the condominium administrator. Naturally, this does not mean that a training experience of this kind can be usefully spent also for personal purposes - considering the considerable diffusion of dwellings in buildings subject to the condominium regulation - or for professional appointments of a different nature, possibly exercised on delegation of a client who lives in a condominium building.
From a more general point of view the course allows a consolidation of the training experience acquired in the course of private law and therefore of the skills and concepts acquired at that location. For example, with reference to the formative values ​​of the legal training, the independence of judgment and the ability to apply knowledge are consolidated with the experience of evaluating the validity of some condominium resolutions, and also applying the aforementioned resolutions of the interpretation of contracts. Naturally, also in light of the experience gained in the course of private law, the student can here more easily use the main tools necessary for the practice of legal assessments (jurisprudential and doctrinal texts). This also develops the capacity for autonomous development of knowledge that is one of the fundamental training objectives of the university preparation considered as a whole.
Particular care is also given to communication skills: for example through the experience of drawing up (parts of) a report of a condominium meeting concerning discussions of particular relevance also on the legal level.
The practice of reading jurisprudential and doctrinal texts, which was previously mentioned, is then supplemented by the reading of less refined texts from a technical-juridical point of view, such as minutes of the condominium assembly, communications from the administrator to the condominiums, letters of assignment of professional assignments etc. In this way, the ability to adapt the criteria for understanding a text to the type to which it belongs is tested.

However, this thematic core of the course can not ignore a wider consideration of the legal experience of the communion of real rights, with particular regard to the points where the general regulation of the communion of real rights also governs the more specific of the condominium in buildings.

From the point of view of content, the specific issue addressed concerns the legal aspects of the experience of building condominiums in buildings and in general of the experience of relationships that are constituted between condominiums: within the condominium and with subjects unrelated to it . However, this thematic core of the course can not ignore a wider consideration of the legal experience of the communion of real rights, with particular regard to the points where the general regulation of the communion of real rights also governs the more specific of the condominium in buildings.
It is not possible here to indicate the other specific articulations of the entire theme dealt with in the course, will be emphasized the topics covered by the recent reform of the building condominium legislation, while the rest is enough a glance of the civil code to get an idea approximate course topics.

Teaching Methods

Textbooks

The reference texts are constituted, as well as by the civil code and the remaining legislation on the subject of building rights, by jurisprudential material and by different documentation inherent to the condominium practice; newspaper articles will also be used

Learning assessment

The verification of learning - that is, in other words, of the actual achievement of the planned training objectives - reflects the seminar character of the teaching reproducing its fundamentally dialogical nature and the general approach of the course inspired, as we have said, to the canons of problem based learning. The student, who will have done a written test in the weekly classroom (starting from the second week of the course) and other exercises written at home, will deal with the exam topics proposed by the teacher by illustrating the exercises carried out during the course. It should be noted that the exercises, endorsed by the teacher, can be re-elaborated by the student at the end of the preparation, in cases where he / she believes that the preparation acquired at the end of the course allows him / her to obtain a better result; the exam then the student will have the opportunity to exhibit the original exercise and the one subsequently revised illustrating the reasons for the subsequent re-elaboration (self-assessment exercise).
The innovative approach of the course allows you to disregard traditionally intended exam texts, for which the student must report the contents during the examination. In fact, the preparation - as well as an unavoidable rereading of some topics in the private law manual - makes use only of the critical reading performed on the documentation (jurisdictional measures, doctrinal passages, minutes of condominium assembly, contractual texts, etc. ) provided by the teacher and used for the exercises done in the classroom and at home.
