Course description

The course aims to illustrate the characteristics, the opportunities as well the legal constraints stemming from the EU legal system. Particularly, explained the institutional and sources scenario of EU law, the course will go in depth the jurisdictional tools offered by EU law to render effective the EU rights

Syllabus

EU legal system. The EU institutions: EU Parliament, Commission, Council, Council of Ministers, EU Court of Justice. EU sources: general principles of EU, fundamental rights protection, international agreements, directives, decisions, regulations, principle of subsidiarity and competence system, direct effect, primacy. Jurisdictional protection: preliminary rulings, infringement procedure, EU non -contractual liability, State liability. Relation between EU and national legal system.
Free circulation of goods and artistic and cultural national haritage. Free circulation of workers and public employment exception in the management of National museums. Free circulation of services and EU directive 2015/2302 on package travel

Institutional legal framework of EU law, included sources and jurisdictional system

Teaching Methods

The training process is based on the theoretical framework classes that relate to the issues in which the present course program. Exercises and case studies discussions will also be made to encourage the development of critical thinking and the implementation capacity of the logical- analytical tools discussed during the lessons.

Learning assessment

The exam will take place in an oral form and it will consist in different questions about the institutional EU framework, the action for jurisdictional protection and relevant acts of EU law on turism and/or culture. In such a way it aims to verify not only the level of knolwedges on the single arguments, but also the ability to develop legal reasonment able to apply general leagl category to specific areas such as turism and culture.
The duration of the exam will depend on the ability of the single student to show his level of knowledges acquisition.
