Course description

The acquisition of legal skills
exegetical-specialized interpretative.

More specifically, the course aims to acquire the following skills and abilities:

I) Knowledge and understanding:
the course offers the tools to perceive the historical dimension of law, the existence of a legal system, the need for exegetical skills in the approach to legal texts.

II) Ability to apply knowledge and understanding:
The course is characterized by a critical and practical approach. It aims to encourage students to reflect on the implications of the sources examined: this aims to train an interpreter of law capable of applying the knowledge acquired on a theoretical level to the concrete case.

III) Autonomy of judgment:
The outlined methodological approach aims to stimulate the student's autonomy of judgment and his ability to critically interpret legal texts.

IV) Communication skills:
The consultation of ancient legal texts aims to favor both the acquisition of an adequate language and the development of dialectical and argumentative skills. Equal attention is paid to developing communication skills through multimedia tools.

V) Learning skills:
Learning ability is stimulated by the submission of specific texts to students. In addition, in-depth material is provided as part of the course.

Prerequisites

A good university legal culture
Basic; the passing of the exams of Institutions and history of Roman law and of History of medieval and modern law.

The course aims to provide final year students, as a completion of their cultural training, with an overview of the relationship between the production of law and the Catholic faith at the time of the first civil codification and the more or less definitive structuring of Christian theology: this thanks to the reconstruction of church-state relations in the 5th century, that is to the roots of the Europe of nations. Preliminarily, the lessons introduce the preparatory legal transformations of the Late Antiquity and then the structuring of the Late Antiquity itself (16 hours). The teaching, with useful tools for carrying out the exegetical examination of important legal documents, then intends to test the critical-textual abilities of students (24 hours).

Teaching Methods

The course consists of a series of lectures using, at times, different audiovisual technologies that require the constant and active participation of students, who will often be encouraged to intervene during the lessons. Furthermore, where possible, the course includes a didactic excursion useful to allow students to compare themselves with the historical reality of the city territory.
