Course description

At the end of the course the student must demonstrate knowledge and know how to learn the problems related to the protection of intellectual property as a tool of competition between companies.
The student must be able to implement the different techniques of protection of innovative results, with particular attention to patent law, trademark law, as tools able to make companies more competitive both nationally, in the European Union, and internationally.
The student must have the ability to explain, in a simple way, to non-expert people, the different techniques of protection of innovative results, with particular attention to industrial property rights and must be able to apply the knowledge acquired to contexts different from those presented during the course.

Prerequisites

Knowledge of the basic aspects of commercial law.

Syllabus

Industrial law, general part; distinctive signs of undertaking, trade marks, concept of sources and function; the facts constituting the right to the trademark.The subjects; the extinction of the trademark right; trademark protection; the circulation of the mark; service marks, unregistered and collective; intellectual creations with technological content; protected creations; inventions; patent law; the right to patent; the requirements for protectability; licences governed by law; counterfeiting, nullity and revocation; designs; administrative order

Patent law and patent right: 24 hours.
Industrial property rights: general profiles; protected creations; exclusive rights; the patent as a constitutive title with retroactive effect; the requirements for protectability; the administrative system.
The Marks: notion, source and function: 24 hours.
The constitutive fact of the acquisition of the trademark right and registration; vulgarization of the brand; the extinction of the trademark right; the circulation of the mark; service and collective marks; trade marks.

Teaching Methods

The teaching activity of the course is organized in lectures of two hours each and jurisprudential research activities commented in the classroom.

Learning assessment

The objective of the exam is to verify the level of achievement of the training objectives previously indicated.
The exam is divided into an oral test in which the ability to connect and compare different aspects covered during the course will be evaluated.
The evaluation of the test takes into account the completeness and accuracy of the answers, as well as the clarity of the exposition.
